Welcome to the Loyalty XP Program offered by X-Golf (“we”, “our”, “us”). These Terms and Conditions govern your participation in the Loyalty XP Program, which is operated in conjunction with the Liven app and services.

By participating in the Loyalty XP Program, you agree to these Terms, as well as the Liven Terms of Service. Continued participation in the program constitutes your acceptance of any updates or changes.

1. Definitions

XP (Reward Dollars): A loyalty currency earned through eligible spend at participating venues.

Brand Dollars: Promotional credits issued by X-Golf HQ for specific campaigns or offers.

Participating Venues: X-Golf locations integrated with the Liven platform and supporting the Loyalty XP Program.

Program: The Loyalty XP Program described herein.

2. Eligibility

To participate, you must:

– Have a valid and active Liven account;

– Be at least 16 years of age;

– Transact at participating X-Golf venues using the Liven app.

3. Earning XP (Reward Dollars)

• Customers earn 10% of the total purchase amount (excluding tax and tips) back in XP on eligible transactions.
• This is an introductory offer and may be modified or withdrawn at our discretion.
• Purchases of functions, events, or memberships are excluded.
• XP is earned only on the portion of the transaction paid with cash/card (not XP or Brand Dollars).

4. Redeeming XP

• XP is redeemable only at participating venues through the Liven app.
• XP cannot be redeemed for memberships, events, or functions unless explicitly stated.
• XP has no monetary value, is non-transferable, and may not be exchanged for cash.

5. Brand Dollars (Promotional Credits)

• Brand Dollars may be granted as part of promotions or offers at X-Golf’s discretion.
• Their usage may be limited by venue, date, product, or value.
• Brand Dollars may expire and are not exchangeable for cash.

6. Validity & Expiry

• XP generally does not expire unless otherwise stated.
• Brand Dollars may include expiry conditions per campaign.
• If an account is inactive for 18 consecutive months, XP and Brand Dollars may expire.

7. Refunds and Adjustments

• Refunds for XP or Brand Dollar purchases are subject to Liven’s refund policy.
• Refunds must be requested within 24 hours and are only possible if funds remain unspent.

8. Monitoring and Fraud Prevention

• We reserve the right to monitor usage and activity for abuse, misuse, or fraudulent conduct.
• X-Golf may suspend or terminate accounts at its sole discretion where misuse is suspected.

9. Modifications and Termination

• X-Golf may modify, pause, or terminate the Program at any time, including XP or Brand Dollar values, without prior notice.
• Your continued use of the Program constitutes acceptance of such changes.

10. Limitation of Liability

• X-Golf is responsible only for the issuance and redemption of XP and Brand Dollars under this program.
• Liven is not liable for disputes arising from Program participation.

11. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

12. Force Majeure

X-Golf shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, power outages, internet failure, or regulatory restrictions.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
